Terms of Use

These Terms of Use (“Terms”) govern your access to and use of parkcincy.com and our ticket portal at app.parkcincy.com (together, the “Sites”), operated by Walnut Street Parking Inc., doing business as ParkCincy (“ParkCincy,” “we,” “us,” or “our”). By accessing or using the Sites, you agree to be bound by these Terms. If you do not agree, do not use the Sites.

1. The Sites are informational

The Sites provide information about our parking lots and garages, monthly permits, season parking passes, and parking tickets. While we try to keep information current, lot availability, rates, hours, and other details may change at any time without notice, and the Sites may contain errors or omissions. Information on the Sites does not constitute a guarantee of parking availability, pricing, or any particular outcome.

2. Parking facilities

Your use of any ParkCincy parking facility is governed by the signage posted at that facility and any separate written agreement you have with us (for example, a monthly permit or season pass agreement). If these Terms conflict with posted signage or a separate agreement, the posted signage or separate agreement controls with respect to your use of the facility. Vehicles and their contents are parked at the owner's risk to the fullest extent permitted by law. Parking rules are enforced at our facilities, and violations may result in ticketing, towing, or both at the vehicle owner's expense as permitted by applicable law and posted signage.

3. Tickets, payments, and contests

Parking tickets may be paid through our portal at app.parkcincy.com using the payment methods offered there. Payments are processed by third-party payment processors, and your use of those processors is subject to their terms. If you believe a ticket was issued in error, you may contest it by following the instructions at app.parkcincy.com/contest. Submitting a contest does not suspend your obligation to resolve the ticket and does not guarantee that the ticket will be reduced or dismissed. Contest decisions are made at our reasonable discretion.

4. Acceptable use

You agree not to:

  • Use the Sites for any unlawful purpose;
  • Interfere with or disrupt the Sites, or attempt to access systems or data you are not authorized to access;
  • Scrape, harvest, or copy content or data from the Sites by automated means without our prior written consent;
  • Submit false or misleading information, including in connection with a ticket contest;
  • Impersonate any person or misrepresent your affiliation with any person or entity.

5. Intellectual property

The Sites and their content — including the ParkCincy name, logo, text, graphics, and design — are owned by ParkCincy or our licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-exclusive license to access the Sites for their intended personal, non-commercial use. No other rights are granted.

6. Third-party services

The Sites link to or rely on third-party services, such as Google Maps and payment processors. Those services are governed by their own terms and policies, and we are not responsible for them.

7. Disclaimer of warranties

THE SITES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. WE DO NOT WARRANT THAT THE SITES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

8. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PARKCINCY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITES. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SITES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US THROUGH THE SITES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE OR ONE HUNDRED DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

9. Indemnification

You agree to indemnify and hold harmless ParkCincy and its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Sites or your violation of these Terms.

10. Governing law and venue

These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Sites will be brought exclusively in the state or federal courts located in Hamilton County, Ohio, and you consent to their jurisdiction.

11. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Your continued use of the Sites after an update means you accept the revised Terms.

12. General

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any provision is not a waiver of our right to do so later. These Terms, together with our Privacy Policy and any posted signage or separate written agreements, are the entire agreement between you and ParkCincy regarding the Sites.
